Fortner was allegedly trespassing at the Buy 2 Market on Diamond Lake. When they asked him to leave he stole muffins, tore them up and then threw them at an employee. He flashed his genitals to alarm the employee and made threatening, profane statements. He trespassed at the next business and was soon contacted by the police. Fortner refused to be taken into custody and resisted arrest. He tried to hit and kick the officers and was pepper sprayed. The pepper spray was ineffective, so Fortner was exposed to a taser, and he was taken into custody. During the preceding struggle he caused a minor injury to an involved officer. Once in custody he spit all over the back of the police car.
